These Terms of Purchase and Refund Policy (the “Agreement”) govern your purchase of products and services from GovCon Winners®, including all related website properties, sales over the phone, and product purchases. By making a purchase from us, you agree to the terms outlined in this Agreement. Please read these terms carefully. GovCon Winners® (hereinafter referred to as "Kizzy Parks", "The Company", "We", "Us", or "Our") stands behind all of its products, and your satisfaction is very important to us. Any and all purchases made from us, including all related website properties, sales over the phone, and product purchases, are covered by the following policies. Offers and coupons cannot be combined unless explicitly stated, and are only valid during the advertised promotion period. All prices are subject to change without notice, and we reserve the right to limit the quantities of any products or services that we offer. Gift cards are non-refundable and cannot be exchanged for cash or used to purchase other gift cards.

We strive to provide accurate pricing and product information; however, errors may occur. In the event that an item is listed at an incorrect price or with incorrect information, we reserve the right, at our sole discretion, to refuse or cancel any orders placed for that item. Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right to refuse or cancel any order for any reason at our sole discretion. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion.

No Guarantee of Results
We do not guarantee that you will achieve any specific personal, professional, financial or other results or earn any specific amount of income or reach any particular goal from purchasing our products and/or services. The information provided is provided only on an informational basis and for your personal use. If you use such information, you do so at your own risk and are solely responsible for any decisions and actions that result from your decision to use such information. We never provide legal, investment, professional, tax, or financial advice.

There is no assumption of responsibility for any errors or omissions that may appear in any program materials or written information. You agree to take full responsibility for any results you receive from the use of any products or services purchased from us.

Any testimonials showing our success or our students’ success should not be interpreted as common, typical, or expected.



No Solicitation Policy
We have a strict no-solicitation policy covering all of our virtual and live events, ZOOM Meetings, Membership ZOOM Calls, ZOOM “meet-ups,” Facebook Groups, Social Media Groups, Official WhatsApp Groups, virtual or live events, conferences, masterminds, training, courses, boot camps, and challenges. To provide a distraction-free environment for our attendees and guests, we do not allow solicitation at any of the aforementioned events by attendees or unauthorized parties. This policy includes but is not limited to the following unauthorized activities.

Prohibited Activities:

Unauthorized receptions & parties (including off-site events)
Unauthorized exhibits, mobile exhibits & hospitality suites
Unauthorized membership recruitment activities
Unauthorized subgroups on social media platforms (including WhatsApp)
Unauthorized sale of any product or service not offered by an affiliated Company
Unauthorized employment recruiting
Unauthorized on-site distribution of printed or electronic materials, including literature, signs, flyers, invitations, tickets, forms, etc. (except business cards)
Unauthorized distribution of virtual invitations to any of the aforementioned prohibited activities
Unauthorized use of the venue’s Wi-Fi, guest Wi-Fi or Company’s Wi-Fi for self-promotional or solicitous purposes
Unauthorized use of the venue for self-promotional or solicitous purposes
Any person and/or organization found to be violating this policy shall be expelled without a refund and may be subject to legal action for any damages incurred by Us.

Attendees found to be violating this policy agree to pay the affected Company and/or Companies the equivalent of a Sponsor or Exhibitor fee plus a pro-rata portion of the event’s cost. Attendees violating this policy shall also be immediately expelled from the event and disqualified from future events at the discretion of any of the Companies.



Physical Products
Most items are fulfilled by 3rd party suppliers, so we cannot refund or exchange the item if you have buyer’s remorse, provide your address incorrectly, or have an unclaimed shipment returned to our 3rd party fulfillment center. Shipments that go unclaimed and are returned will be liable for the cost of a reshipment. If any address is considered insufficient by the courier and is returned, you will be liable for reshipment costs once we have confirmed an updated address with you. Any claims for misprinted/ damaged/ defective items/packages lost in transit must be submitted directly to our customer service department within 30 days of purchase. You can contact our Customer Service Department during the hours of 9 AM – 6 PM EST, Monday through Friday at cs@kizzyparks.com



Digital Download Products
There are no refunds at all on any digital products. You will receive access to the university training platform for the time stated on the product description you purchased. If you have any problems accessing the digital content you have purchased, please contact our Customer Support Department immediately at cs@kizzyparks.com during the hours of 9 AM – 6 PM EST, Monday through Friday so that we can resolve the issue.

Purchase of a Kizzy Parks or GovCon Winners® training module does not grant rights to the buyer to share, reproduce, or resell the product in any way. Digital Access is deemed fully delivered when the email is sent to the email address used to sign up for the services. If you do not receive the digital access link within 5 calendar days of signing your service agreement, it is incumbent upon you to email cs@kizzyparks.com to inform the Company that you have not received the link. If you have not sent an email to notify the Company that you have not received the link and the email was delivered to your email address, the digital assets are deemed fully delivered.



Live Calls and Virtual Sessions
Live calls, webinars, and virtual sessions are non-refundable once scheduled. If you encounter technical issues, please contact our support team immediately at cs@kizzyparks.com during the hours of 9 AM – 6 PM EST, Monday through Friday so that we can resolve the issue.

Unauthorized recording or distribution of these sessions is prohibited. Participation in live calls and virtual sessions is subject to our code of conduct, and any inappropriate behavior may result in removal from the session without a refund. By participating in these sessions, you agree not to share, reproduce, or resell any portion of the content without explicit permission from the Company.



Modifications and Cancellations
Please be advised that any and all agreements for downloadable/digital products are NOT subject to cancellation, refund, or store credit. We do not accept any verbal modifications of these Agreements, and the “no refund and no cancellation” policy stated in the Agreements is strictly adhered to. AFTER the full term of the agreement has expired, you may request to cancel the automatic renewal of the Agreement, or your Agreement will be converted into a month-to-month Agreement. Any cancellations submitted before the full term of the agreement will only cancel the auto-renewal, and your monthly invoices will still be due and owing until the full value of the agreement has been paid in full.



Subscriptions And Payment Plans
By purchasing our products or services, you agree to all Terms of Use and this Terms of Purchase and Refund Policy. You agree not to initiate a chargeback for any services rendered or digital products delivered. You also agree and acknowledge that you pay monthly installments on your total contract value as a payment plan, not a recurring subscription fee. Canceling or removing the credit card on file does not cancel your payment plan and violates the terms of the agreement. If at any time you have delinquent invoices past 30 days, or the account is paid delinquently for one payment, your account will be suspended, and you will still be liable for the full contract value through the agreement term. Please reach out to your payment plan provider for specifics.

If you have any problems accessing the digital content you have purchased, please contact our Customer Support Department immediately at cs@kizzyparks.com during the hours of 9 AM – 6 PM EST, Monday through Friday so that we can resolve the issue. Digital product purchases do not grant rights to the buyer to share, reproduce, or resell the product in any way.



Gift Certificates and Coupon Codes
If you have received a coupon code for free merchandise or a gift certificate for merchandise from the Company or any of its affiliates, the coupon code or gift certificate is only good for a single use and up to the value on the code or card. Any physical items purchased are in accordance with the refund policy and digital products are nonrefundable and not eligible for exchange or store credit. Gift Certificates and Coupon codes shall expire twelve (12) months from their date of issue, unless otherwise specified.



Payment Methods and Terms
We accept various payment methods, including major credit cards, PayPal, and other payment options as specified on our website. By providing a payment method, you represent and warrant that you are authorized to use the designated payment method and that you authorize us (or our third-party payment processor) to charge your payment method for the total amount of your purchase (including any applicable taxes and other charges). If the payment method cannot be verified, is invalid, or is otherwise not acceptable, your order may be suspended or canceled. You must resolve any payment issues before we proceed with your order. All billing information provided must be truthful and accurate. Providing any untruthful or inaccurate information constitutes a breach of these Terms of Purchase and Refund Policy, and may result in cancellation of your order. We reserve the right to adjust prices as necessary without notice.



Limitation of Liability
To the fullest extent permitted by law, GovCon Winners® shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

your use or inability to use our products or services;
any unauthorized access to or use of our servers and/or any personal information stored therein;
any interruption or cessation of transmission to or from our services;
any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services by any third party;
any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through our services; and/or
the defamatory, offensive, or illegal conduct of any third party
In no event shall GovCon Winners®’s aggregate liability for all claims related to the services exceed the greater of one hundred U.S. dollars (USD $100.00) or the amount you paid GovCon Winners® in the past twelve months for the services at issue.



Governing Law and Dispute Resolution
These Terms of Purchase and Refund Policy and any separate agreements whereby we provide you products or services shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any disputes arising out of or related to these terms, the use of our services, or the purchase of any products shall be resolved through mediation, and if necessary, binding arbitration conducted in Florida, USA. You agree to submit to the jurisdiction and venue of such courts and waive any objection to such jurisdiction or venue. Any arbitration under these terms shall be conducted on an individual basis; class arbitrations and class actions are not permitted. Each party shall bear its own costs and expenses of any such mediation or arbitration, including attorney’s fees.
